TERMS & CONDITIONS

These General Terms and Conditions define the contractual relations between the guest(s) and "MDG Properties" Ltd for the provision of short-term rental accommodation in properties offered by "MDG Properties" Ltd (listed below). By making a reservation, paying any part of the accommodation price, providing the necessary personal data, and/or using the premises, individuals agree to be legally bound by these conditions. This agreement applies universally to all Guests and is available on our official website - www.paradise-apartments.eu

Definitions
  1. “Paradise Apartments” refers to the accommodation properties offered by "MDG Properties" Ltd for which these terms and conditions apply.

  2. „Guest“ refers to any person who makes a reservation at Paradise Apartments. This definition also applies to all additional guests who may stay at the property under the reservation, even if they did not make the reservation themselves.

  3. „MDG Properties“ Ltd. refers to the company managing Paradise Apartments, responsible for managing reservations, maintaining the property, and ensuring compliance with local regulations and these terms and conditions.

  4. „Apartments“ refers to the apartments and rental properties available for reservation as specified on our reservation platform and in our promotional materials. Each apartment is equipped for residential use and can be reserved and used in accordance with these terms and conditions.

  5. „House Rules“ are specific provisions established by "MDG Properties" Ltd governing the behaviour and responsibilities of guests during their stay. These rules include, but are not limited to, noise restrictions, property use policies, and maintenance requirements and aim to ensure the safety, comfort, and well-being of all guests and staff.
Reservation and Payment Policy
  1. The guest may initiate a reservation of an apartment through the channels provided on the website of Paradise Apartments or through external platforms offering the services of "MDG Properties" Ltd. The initiation of the reservation is performed by selecting an apartment, dates of stay, and the number of guests who will stay in the apartment.

  2. A reservation can be made through the following methods:

    • Via an integrated booking system on the website of Paradise Apartments;

    • Via variety of communication methods (telephone, email, chat);

    • Via an external reservation platform.

  3. When choosing to use the integrated booking system on the website, the Guest is redirected to the reservation processing platform, through which they can complete the process by providing all required data according to the reservation form. 

  4. When choosing to make a reservation via telephone call, email, or chat communication, the Guest must provide all required personal data to an employee of "MDG Properties" Ltd to be entered into the integrated booking system, through which the reservation is created.

  5. When choosing to make a reservation through an external reservation platform, the guest must fill in all required personal data by the platform and comply with the reservation requirements set there.

  6. The reservation is considered made after the guest selects a payment option and makes at least the initial required payment according to the chosen option. Payment options include:

    • Full payment of the price via the integrated payment terminal in the last step of the reservation process.

    • Full payment of the price via bank transfer up to 3 days from completion of the reservation process.

  7. The prices for the services, namely short-term accommodation services, are those listed on the website of Paradise Apartments or on the respective platform used by the Guest to access reservation functionalities at the time of making the same, except in cases of obvious error.

  8. To ensure a more complete and enjoyable stay for its guests, "MDG Properties" Ltd may offer additional services for a fee with each reservation. The provision and purchase of these services are subject to availability and assessment by "MDG Properties" Ltd at the time of the stay period, and the company reserves the right to refuse their provision.

  9. Prices include VAT where its application is previsional.

  10. Prices include tourist tax which is additionally charged on top of the base price for the stay. It is calculated per person per night based on the price defined annually by the local municipality.

  11. "MDG Properties" Ltd reserves the right to change the prices of the offered services at any time and without notice; such changes will not affect reservations completed at the time of the change.

  12. The guest may pay the price of the reservation through the following methods:

    • By bank or payment card in accordance with the general terms of the respective payment operator whose services are used by "MDG Properties" Ltd.

    • By bank transfer, in which case the payment is considered made when the "MDG Properties" Ltd account is credited with the amount transferred by the Guest.

    • Through payment services offered by payment operators licensed to operate as such in the Republic of Bulgaria or by license issued in another EU member state, if such an option is available on the respective platform used to make the reservation.

  13. "MDG Properties" Ltd reserves the right to establish other payment methods on the website, including through third-party services – payment operators, as well as cash payments on-site at a commercial establishment after placing an order.

  14. If the Guest chooses a payment method involving a third-party payment service provider, the Guest may be bound by the provisions, conditions, and/or fees of such a third party, including with respect to the fees due for carrying out the respective payment transaction.

  15. After receiving the full payment, "MDG Properties" Ltd sends a reservation confirmation via email. This confirmation serves as proof of the booked stay and includes details such as dates, prices, and specifics of the accommodation.

  16. Check-in and Check-out at the properties managed by "MDG Properties" Ltd is set as:

    • Check-in at 15:00 on the first day of the reservation. "MDG Properties" Ltd reserves the right to provide its guests, at additional cost, with the option for Early Check-in as stipulated in point (8) of the current Terms and Conditions.

    • Check-out at 11:00 on the last day of the reservation. "MDG Properties" Ltd reserves the right to provide its guests, at additional cost, with the option for Late Check-out as stipulated in point (8) of the current Terms and Conditions.

Cancellation Policy
  1. Cancellation by the Guest is allowed under the following conditions and only if the Guest has chosen a price package that allows cancellation of the reservation, information about which is available at the time of making the reservation:

    • 11 or more days before check-in date: Full refund of the amount.

    • 10 to 4 days before check-in date: 50% refund.

    • 3 days or less before check-in date: No refund of the amount.

  2. Each reservation is valid until 23:59 on the check-in date. If the guest does not show up, the reservation is canceled and the paid amount is not refunded.

  3. Guests who expect to arrive late must notify "MDG Properties" Ltd in advance to possibly extend the validity of their reservation.

  4. Under Article 116 of the Tourism Act of the Republic of Bulgaria, "MDG Properties" Ltd is required to collect and provide personal data of each guest (whether primary or not) to the Unified System for Tourist Information. If the guest refuses to provide all required data, "MDG Properties" Ltd reserves the right to cancel the reservation and may, at its discretion, but is not obligated to, refund part or all of the paid amount.

  5. "MDG Properties" Ltd reserves the right to cancel a reservation if the guest fails to pay the full amount due 10 or more days before the check-in date. In such cases, "MDG Properties" Ltd reserves the right to retain all sums paid up to that point.

  6. "MDG Properties" Ltd reserves the right to cancel any reservation due to legitimate reasons, force majeure circumstances, including acts of God, which would prevent us from fulfilling our obligations. In such cases, the full amount will be refunded.

  7. In the event of a cancellation of a reservation, which results in a full or partial refund of the amount paid by the Guest, "MDG Properties" Ltd will refund the amount using the same payment method used by the Guest.


Rights and Obligations of "MDG Properties" Ltd
  1. "MDG Properties" Ltd is committed to ensuring an undisturbed stay for the guest in the apartment for the duration of the reservation.

  2. "MDG Properties" Ltd is not responsible for items belonging to the guest that are damaged or left in the apartment during and after their stay.

  3. "MDG Properties" Ltd is not responsible for the loss or damage of money, securities, valuables, or items of scientific or artistic value belonging to the guest.

  4. "MDG Properties" Ltd is not responsible for injuries that the Guest may suffer as a result of staying at Paradise Apartments, including injury to the Guest's health that is not caused culpably or as a result of gross negligence by "MDG Properties" Ltd. If, upon staying at the property subject to the reservation, the Guest finds that there is equipment or any other part of the property that would endanger their life and/or health, as well as those of other guests in the property, the Guest undertakes to inform "MDG Properties" Ltd in a timely manner about the danger and has the responsibility to protect himself and accompanying guests from injury. For its part, "MDG Properties" Ltd undertakes to remove the danger within a reasonable time and with care for the safety of the guests. 

Rights and Obligations of the guests
  1. The guest must inform "MDG Properties" Ltd of any damages, breakdowns, and/or destruction of the property immediately after they occur.

  2. The guest bears full responsibility for any damage or destruction of the equipment and technical devices in the apartment caused directly by the guest or their visitors. Damages caused by the guest will be repaired by "MDG Properties" Ltd at the guest's expense.

  3. The guest agrees not to transfer/provide access to the apartment/property to a third party during their stay in the apartment or after its end.

  4. Only the individuals listed at the reservation as guests have the right to stay in the apartment during the rental period.

  5. In the event of damage to the apartment that prevents its leasing to subsequent tenants, "MDG Properties" Ltd reserves the right to charge the responsible Guest for the costs of unfulfilled reservations during the repair period (missed profits).

  6. Upon arrival at the apartment, guests should familiarise themselves with the available inventory list of all items in the apartment. Guests are required to check this inventory to ensure that everything is present and in working order. If an item is missing or not functioning, guests must immediately inform "MDG Properties" Ltd. Failure to report discrepancies upon arrival will be considered confirmation that the inventory is complete and functioning.

  7. The guest agrees to abide by the House Rules of the apartment and the building, which are considered incorporated into these terms and conditions and can be found at: 

    • The web based ”Personal Concierge”, access to which have every guest with valid reservation.

    • On paper at the property

Final Provisions
  1. The intellectual property rights over all materials and resources located on the website of Paradise Apartments (including available databases) are subject to protection under the Copyright Act and related rights, belong to "MDG Properties" Ltd or the respectively indicated person who has granted the right to use to "MDG Properties" Ltd, and may not be used in violation of current legislation.

  2. In cases of copying or reproducing information beyond what is permissible, as well as any other infringement of the intellectual property rights over the resources of "MDG Properties" Ltd, the same has the right to claim compensation for both direct and indirect damages in full.

  3. Except where explicitly agreed upon, the Guest may not reproduce, modify, delete, publish, distribute, or otherwise disclose the informational resources published on the website of "MDG Properties" Ltd.

  4. "MDG Properties" Ltd is committed to exercising due care to ensure that the Guest has normal access to the services provided through the website.

  5. "MDG Properties" Ltd reserves the right to suspend access to the provided services. "MDG Properties" Ltd has the right, but not the obligation, at its discretion, to delete informational resources and materials published on its site.

  6. These Terms and Conditions are governed by Bulgarian legislation. All disputes arising from or related to these conditions are subject to the exclusive jurisdiction of the courts in Bulgaria.

  7. "MDG Properties" Ltd reserves the right to change these Terms and Conditions at any time. All guests will be notified of significant changes in advance. These Terms and Conditions aim to provide clear and comprehensive legal guidelines to ensure a mutually acceptable experience while staying at Paradise Apartments.
